Plain language. No tricks. Below is what FairwaySwing promises you, what you promise back, and what neither side gets to do.
Who this agreement is with.
By installing or using FairwaySwing, you enter an agreement with JuneauLabs LLC, an Ohio limited liability company, referred to in this document as we or FairwaySwing.
You also separately agree to Apple's standard Licensed Application End User License Agreement, which applies to any app distributed on the App Store. Where Apple's terms conflict with ours on a question of App Store distribution, Apple's terms govern.
What FairwaySwing provides.
An iOS app that lets you record a golf swing, receive a written analysis generated by a multimodal model, ask follow-up questions about that analysis, and (on Pro) receive periodic digests across your filed swings. That is the service.
We do not provide medical advice, certified instruction, fitting recommendations, or guarantees about your scoring. The app is a coaching tool, not a coach with credentials.
Subscriptions and billing.
Pro is sold as an auto-renewing subscription through Apple's App Store. We do not see, store, or process payment card information.
Your account, your content.
You sign in with email and password, with Apple, or with Google. Whichever method you choose, keep your credentials secure; we never see your password or your OAuth provider's password.
Your swings, analyses, chats, and digests remain yours. By using the app you grant FairwaySwing a narrow, revocable license to transmit each clip to our subprocessor for the sole purpose of returning your analysis, and to store the clip and the resulting analysis on our server so you can return to them on any device where you sign in. That is the entire scope of the license. We do not publish, republish, or train any public model on your content. See the Privacy page for retention specifics.
Acceptable use.
Use the app for what it is for: analyzing golf swings filmed by you, or by someone who has agreed to be filmed.
- Do not upload footage of a person who has not consented to being recorded.
- Do not use the app to harass, surveil, or score another person without their knowledge.
- Do not attempt to extract, mirror, or train competing models on the service.
- Do not abuse the chat features to produce content unrelated to coaching a golf swing.
We may suspend or terminate access if any of the above happens repeatedly.
Honest limits, kept honest.
The analysis is generated by a probabilistic model. It is usually a good read; it is sometimes wrong. Treat it as you would a thoughtful friend with a phone, not a tour coach. Specifically:
- The model can miss subtleties of grip, weight transfer, or stance that a human coach would catch.
- Recommended drills are general, not personalized to your physiology or injury history. Consult a professional before changing your swing materially.
- The app is not a medical device and does not diagnose injury or musculoskeletal issues.
- Service availability depends on Apple's App Store and Google's Gemini API; we do our best to minimize downtime, but we cannot guarantee uninterrupted service.
Ending the agreement.
You can stop using the app at any time by deleting it. Cancel any active subscription through your Apple ID first; otherwise Apple will continue to bill until the end of the cycle.
We may suspend or terminate your access if you violate § 05 (Acceptable use), if you abuse the service in a way that puts other users at risk, or if we are required to do so by law. We will give notice in the app where we are able to.
Disclaimers and liability.
To the maximum extent allowed by law: the service is provided as is, without warranty of any kind, express or implied. We do not warrant that the analysis will be accurate, that the app will be uninterrupted, or that any specific score, handicap, or outcome will result from following its suggestions.
Our aggregate liability to you for any claim arising out of or relating to the service is capped at the amount you paid us for the twelve months preceding the claim, or one hundred US dollars, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.
Some jurisdictions do not allow the limits above; in those jurisdictions, our liability is limited to the smallest amount the law allows.
Governing law and disputes.
These terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved by writing to legal@fairwayswing.app first will be resolved in the state or federal courts located in Ohio, and you and we agree to that venue.
